Chapter 17.40 - RESIDENTIAL ZONE R-3

17.40.010 - Objectives and characteristics of the zone.

A.

The R-3 residential zone has been established as a district in which the primary use of the land is for multifamily residential purposes, but in which office buildings and certain other uses of a semi-commercial nature may be located. In general, this district serves as a transitional zone between the commercial zone and the residential zones surrounding the commercial zone. Since this zone is essentially residential in character, office buildings, rest homes, mortuaries, parking lots and other transitional uses must be developed and maintained in harmony with the residential uses. While a greater amount of automobile traffic and automobile parking is characteristic of this zone, attractive lawns, trees, shrubs, both on the street and around the buildings, is also characteristic of this zone.

B.

In order to accomplish the objectives and purposes of this title, and to stabilize and protect the essential characteristics of this zone, the regulations set out in this chapter shall apply in the R-3 residential zone.

17.40.020 - Permitted uses.

The following buildings, structures and uses of land shall be permitted, upon compliance with the requirements set forth in this title:

A.

Any use permitted in the R-2 residential zone;

B.

Multiple-family dwellings containing thirty (30) or less dwelling units;

C.

Office buildings, or a group of office buildings on one lot, but not including retail or wholesale commercial establishments;

D.

Hospitals and clinics;

E.

Public parking lots;

F.

Nonflashing signs advertising the services performed within the building, and signs designating the name of a building, provided such signs shall be attached to and placed flat against the wall of the building, and provided no part of such signs shall extend more than five feet from the building wall, and provided that any lights used to illuminate such signs shall be shielded or diffused;

G.

Mortuaries and wedding chapels;

H.

Residential facilities for the elderly in accordance with Utah Code and Chapter 17.92 of the Zoning Ordinance;

I.

Residential facilities for persons with a disability in accordance with Utah Code Annotated, Titles 62A-2 and 26-21 and Chapter 17.90 of the zoning ordinance.

17.40.030 - Conditional uses.

The following uses shall be permitted only when authorized by a conditional use permit, as provided in Chapter 17.76:

A.

Multiple-family dwellings containing more than thirty (30) dwelling units;

B.

Bachelor/bachelorette dwellings, boarding house;

C.

Home occupations.

17.40.040 - Minimum area requirements.

The following are the minimum area requirements for the R-3 zone:

A.

For each residential building, seven thousand five hundred (7500) square feet, plus one thousand (1,000) square feet for each dwelling unit in excess of one in each building;

B.

For other main buildings, seven thousand five hundred (7500) square feet.

17.40.050 - Minimum width requirements.

The following are the minimum width requirements, measured at the thirty (30) foot setback line, in the R-2 zone:

A.

One, two, three and four-family dwellings, one hundred (100) feet;

B.

One-family attached dwelling, seventy (70) feet;

C.

All other buildings shall have one hundred (100) feet of frontage or the minimum frontage required to accommodate the building plus the setbacks, whichever is wider.

17.40.060 - Location requirements.

A.

Any lot that has frontage along a road that runs along a section or quarter section line shall be set back a minimum of eighty-three (83) feet from the center of the road.

B.

Front Setback.

1.

All dwelling units shall be set back at least thirty (30) feet from the back of the curb or fifty-one (51) feet from center of the road.

2.

All garages (attached or detached) and other accessory buildings and structures shall have the same setback as the main structure.

C.

Side Setback.

1.

All dwellings and other buildings shall be set back from the side property line a distance of at least eight feet from property line.

2.

The minimum side setback for accessory buildings shall be the same as for main buildings, except that no side setback shall be required for accessory buildings located twelve (12) feet or more in back of the dwelling.

3.

On corner lots, the side setback from the street for any building shall not be less than twenty-five (25) feet from the back of the curb or forty-six (46) feet from the center of the road.

D.

Rear Setback.

1.

All dwellings and other main buildings shall be set back from the rear property line a distance of at least thirty (30) feet except as outlined at subsection E of this section. Accessory buildings shall be set back at least one foot from the rear property line.

2.

For corner lots, all dwellings and other main buildings shall be set back from the rear property line a distance of at least thirty (30) feet. Accessory buildings shall be set back at least one foot from the rear property line.

E.

Exceptions.

1.

Any lot that has frontage along a road that runs along a section or quarter section line and has an eighty-three (83) foot front setback may have a setback of ten (10) feet in the rear.

2.

Lots of less than twelve thousand (12,000) square feet within an approved subdivision as evidenced by an official subdivision plat recorded in the office of the Uintah County recorder where all dwellings and other main buildings are set back from the front lot line no more than thirty (30) feet may locate within ten (10) feet of the rear property line.

17.40.070 - Height requirements.

The following are the height requirements in the R-3 zone:

A.

Minimum, none;

B.

Maximum, none for residential dwellings; thirty-five (35) feet for other main buildings, except churches and schools. For buildings within one thousand three hundred twenty (1320) feet of airport property, the building plans shall be approved by the Federal Aviation Administration prior to issuance of a building permit.

17.40.080 - Special provisions.

A.

Special provisions for the R-3 zone are the same as required in the RA-1 residential zone;

B.

Plans showing proposed off-street parking layout and landscaping shall be submitted to and approved by the zoning administrator for buildings containing three or more dwelling units, rest homes, clubs, lodges, churches, schools, office buildings, clinics, mortuaries and similar structures and similar uses, prior to the issuance of a building permit. The plans shall provide that all land not covered by buildings or by off-street parking space shall be planted to lawn, trees, shrubs or groundcover, and otherwise landscaped and maintained in accordance with good landscaping practice. Only twenty-five (25) percent of the required front yard setback space shall be used for automobile parking and the rest shall be landscaped and maintained with lawn, trees, shrubs or groundcover.

C.

At least thirty (30) percent of the residential lot area shall be maintained in open space. At least twenty (20) percent of the nonresidential lot area shall be maintained in open space.

D.

Dwelling structures containing more than two dwelling units shall be connected to a public sewer system.

E.

All dwellings shall be supplied with approved potable water in accordance with current health and building codes.
